CaraQ End User License Agreement

IMPORTANT - READ CAREFULLY BEFORE INSTALLING THE SOFTWARE!:
This End User License Agreement (EULA) is a legal agreement between you (either an individual or organization) and Goqoo Online Entertainment Limited for CaraQ Room software, and any updates, server, related websites, media, publications, online documentations, and any other related materials provided by CaraQ Room software. By installing, downloading, copying, accessing, or otherwise using any portion of this Software, you agree to be bound by the terms of this EULA. You assume full responsibility for the use of this software and agree to use the software legally and responsibly. If you do not agree to the terms of this EULA, do not install, copy or use the software.

1.GRANT OF LICENSE
Subject to the conditions and limitations set forth below, Goqoo Online Entertainment Limited grants you, at no charge, a limited, non-exclusive, non-sublicensable, non-assignable license to use, download, and install the CaraQ Software on Your computer, phone or PDA for personal Internet communication application using. All rights not expressly granted herein are reserved by Goqoo Online Entertainment Limited.

2.RESTRICTIONS
a.Sell, rent, lease, distribute, sublicense, assign, or otherwise transfer the Software, or any full of partial copies thereof;
b.Remove any copyright notice or licensing information contained in the Software; or
c.Reverse engineer, decompile, debug or disassemble the Software, except and only to the extent that such acts cannot be prohibited under applicable law; or
d.Use any manner to get into the server system and obtain any illegal documentations and unauthorized data; or
e.Modify the Software in any way.

3.SERVICES
Goqoo Online Entertainment Limited owns all the materials from the CaraQ software and may provide you with support services (server) related to the Software. Use of services is strictly governed by the Goqoo Online Entertainment Limited policies. Goqoo Online Entertainment Limited reserves the right to terminate this EULA if you fail to comply the terms and conditions of this EULA. In such case, you must destroy or uninstall all copies of the SOFTWARE PRODUCT and all of its component parts.

4.PRIVACY
To show our commitment of protecting user’s privacy, we have adopted the following privacy guidelines for this SOFTWARE PRODUCT and the CaraQ website. (www.caraq.com)
a.We do not sell, rent, exchange, or publicize any personal information, including specific information about your accounts or other identifiable information to any third party group.
b.You authorize Goqoo Online Entertainment Limited to use your non-specific information to generate statistics on general user activity, including transaction patterns; however, these initiatives will never include any personal identifiable information without users’ consent.
c.You allow Goqoo Online Entertainment Limited to publicize your personal information under situations which are listed below:
1)Request from the government agencies/ law enforcement; or
2)To protect the property and rights of Goqoo Online Entertainment limited; or
3)To protect the safety of CaraQ members and public in some emergency cases, such as criminal acts etc.

5.ACCOUNT AND PASSWORD
When you register as a CaraQ member, you will need to provide an ID name and a set of password. Once you have set up your ID name, it can not be changed; however, you are able to change your password as you need it. Please be aware that Goqoo Online Entertainment Limited will not ask for your password under any circumstance. You are responsible for your own ID name and password, and you agree not to pass your password or ID name to other people. If you found any illegal access to your account, please notify us immediately. Goqoo Online Entertainment Limited is not responsible for any loss according to your negligence.

6.COPYRIGHT
All title and intellectual property rights in and to the SOFTWARE PRODUCT (including but not limited to any images, animations, models, video, and text incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by Goqoo Online Entertainment Limited. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE PRODUCT is the property of Goqoo Online Entertainment Limited and may be protected by applicable copyright or other intellectual property laws and treaties. You may not change the product names, company logo and copyright content on any images, animations, packages, and booklets. However, you have the copyright for all CaraQ which are created by you; on the other hand, you must note that all CaraQ are created from Goqoo Online Entertainment Limited. This EULA grants you no rights to use such content for commercial earning. All rights not expressly granted are reserved by Goqoo Online Entertainment Limited.

7.TRADEMARKS
This EULA does not grant you any rights in connection with any trademarks or service marks of Goqoo Online Entertainment Limited.

8.LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall Goqoo Online Entertainment Limited be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the SOFTWARE PRODUCT or the failure to provide support services, even if Goqoo Online Entertainment Limited has been advised of the possibility of such damages.

9. MISCELLANEOUS
Goqoo Online Entertainment Limited does not guarantee for Internet stability and service (including but not limited to users’ requests, service interruption, immediate responses, safety and errors).

YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND UNDERSTAND THE RIGHTS, OBLIGATIONS, TERMS AND CONDITIONS SET FORTH HEREIN. BY CLICKING ON THE ACCEPT BUTTON AND/OR CONTINUING TO INSTALL THE CARAQ SOFTWARE, YOU EXPRESSLY CONSENT TO BE BOUND BY ITS TERMS AND CONDITIONS AND GRANT TO GOQOO ONLINE ENTERTAINMENT LIMITED THE RIGHTS SET FORTH HEREIN.
